Article 3 Quality and acceptance of ready-mixed concrete

3.1預拌混凝土生產(chǎn)、施工過程及質(zhì)量標準與驗收規(guī)則，應符合ＧＢ/Ｔ14902等現(xiàn)行國家和行業(yè)有關混凝土標準以及本合同約定。

3.1 The production of ready-mixed concrete, construction process and quality standards and acceptance rules shall be in accordance with GB/T14902 and other current State’s and industrial standards for concrete in addition to the agreement of this contract.

3.2乙方應按預拌混凝土技術規(guī)范和有關規(guī)定組織生產(chǎn)，按國家標準要求，制作出廠檢驗試塊，制作出廠檢驗報告，并根據(jù)甲方要求將出廠檢驗報告提供給甲方。

3.2 Party B shall organize the production as per the technical specifications of ready-mixed concrete and relevant regulations, make factory inspection test blocks as the requirements of State’s standards, make factory inspection reports, and furnish the factory inspection reports to Party A under Party A's requirements.

3.3乙方應按預拌混凝土供應批次填寫《預拌混凝土出廠合格證》，保證產(chǎn)品質(zhì)量和數(shù)量。

3.3 Party B shall fill in the Certificate of Conformity of Ready-Mixed Concrete subject to the batch of ready-mixed concrete supplied to ensure the quality and quantity of products.

第四條 價款結算及付款方式

Article 4 Price settlement and payment method

4.1甲方現(xiàn)場簽收的預拌混凝土發(fā)貨單為雙方進行預拌混凝土結算的依據(jù)。

4.1 The delivery note of ready-mixed concrete signed by Party A on site shall be the basis for the settlement of ready-mixed concrete.

4.2甲、乙雙方約定對賬、結算期限：

4.2 The period of reconciliation and settlement agreed by parties:

4.2.2甲方如對乙方結算資料有異議，甲方應在10天內(nèi)書面通知乙方，乙方應為結算提供便利條件并派人參加，如乙方收到書面通知后不參加結算，按甲方結算結果為準，作為預拌混凝土價款支付的依據(jù)。

4.2.2 Party A which if has any objection to Party B's settlement information shall notify Party B in writing within 10 days and Party B shall furnish convenient conditions for the settlement and dispatch its personnel to participate in the settlement, if fails to do so upon receipt of the written notice, the settlement result shall be subject to the settlement result of Party A, which shall be the basis for the payment of the price of ready-mixed concrete.

第五條 甲方的責任和義務

Article 5 Responsibilities and obligations of Party A

5.1甲方要求乙方首次供應預拌混凝土時，應提前2天向乙方遞交書面供貨通知，在通知中注明預拌混凝土的強度等級、數(shù)量、時間和澆筑部位，以及其它技術要求。

5.1 Party A which request Party B to supply ready-mixed concrete for the first time shall, two days in advance, submit a written notice of supply to Party B, in which the strength grade, quantity, time and pouring part of ready-mixed concrete, in addition to other technical requirements specified.

5.8甲方應按本合同規(guī)定及時向乙方支付貨款，甲方不按合同約定支付貨款超過30日的，視為甲方違約，乙方可停止供貨并有權解除合同，甲方承擔違約責任。

5.8 Party A shall effect the payment to Party B in time as per the provisions of this contract. Failure of Party A’s payment for more than 30 days as stipulation of the contract will be deemed as Party A's breach of contract, and Party B may stop the supply and has the right to terminate the contract, and Party A shall undertake the responsibility for the breach of contract.

5.9甲方需提供專用洗車場地，并委托專人對乙方進出施工現(xiàn)場的車輛進行沖洗，并達到環(huán)保要求。

5.9 Party A shall provide wash site for special vehicles and appoint special worker to wash Party B's vehicles in and out of the construction site and meet the environmental protection requirements.

第六條 乙方的責任和義務

Article 6 Responsibilities and obligations of Party B

6.1乙方按合同要求提供預拌混凝土。

6.1 Party B shall provide ready-mixed concrete as per the contract requirements.

6.2預拌混凝土配合比設計由乙方按合同簽訂時執(zhí)行的GB/T14902等有關現(xiàn)行國家標準。乙方應按國家有關規(guī)定及甲方要求向甲方提供相關資料。雙方對預拌混凝土技術標準有特殊要求的，可另行協(xié)商。

6.2 The design of ready-mixed concrete proportion shall be truckried out by Party B in accordance with GB/T14902 and other relevant current State?s standards executed at the time of concluding the contract. Party B shall furnish relevant information to Party A in accordance with relevant State?s regulations and Party A's requirements. Any special requirements on the technical standards of ready-mixed concrete may be negotiated separately by the parties hereto.

6.3乙方向甲方提供《預拌混凝土作業(yè)指導書》，提示甲方嚴格按國家標準、規(guī)范的要求進行預拌混凝土澆筑施工與養(yǎng)護。

6.3 The Operation Instructions for Ready-mixed Concrete submitted by Party B to Party A prompts Party A to truckry out the pouring construction and maintenance of ready-mixed concrete in strict accordance with the requirements of State’s standards and specifications.

第八條 違約條款

Article 8 Default Article

8.1違約行為及處理方式如下：

8.1 The breach of contract and the settlement means as follows:

8.1.1合同正常履行過程中，任何一方不得無故單方解除合同，若單方擅自解除合同或因未按合同約定履行導致對方解除合同的，則違約方需按______支付違約金。

8.1.1 During the normal performance of the contract, no party shall unilaterally terminate the contract without any reason; if unilaterally terminate the contract without authorisation or cause the opposite party to terminate the contract due to failure to perform as stated in the contract, the defaulting party shall be required to pay liquidated damages in accordance with ______.

8.1.2如甲方不能按合同約定履行付款義務，每逾期一日，按遲延付款金額的_____支付違約金。逾期超過30天的，乙方有權解除合同，并停止預拌混凝土的供應。

8.1.2 Party A which if fail to fulfill the payment obligation as stated in the contract shall pay liquidated damages at the rate of _____ of the delayed payment amount for each delayed day. If the delay exceeds 30 days, Party B has the right to terminate the contract and stop the supply of ready-mixed concrete.

附件二：《預拌混凝土作業(yè)指導書》

Appendix 2：

Operating Guidelines for Ready-mixed Concrete

乙方生產(chǎn)的預拌混凝土是嚴格按現(xiàn)行國家標準加工生產(chǎn)。為保證混凝土工程質(zhì)量，根據(jù)GB/T14902《預拌混凝土》、GB50164《混凝土質(zhì)量控制標準》、GB50204《混凝土結構工程施工質(zhì)量驗收規(guī)范》等現(xiàn)行標準要求，甲方在驗收、澆筑和養(yǎng)護過程中應注意以下主要事項：

The ready-mixed concrete produced by Party B is processed and produced strictly according to the current State’s standards. In order to ensure the quality of concrete works, according to the requirements of GB/T14902 'Ready-mixed Concrete’, GB50164 'Standards for Concrete Quality Control’, GB50204 'Code for Quality Acceptance of Concrete Structural Engineering Construction’ and other current standards, Party A shall pay attention to the following main matters during the acceptance, pouring and maintenance process:

一、技術交底。

1. Technical delivery.

2.有特殊技術要求或特制預拌混凝土，甲方應當至少提前7天與乙方聯(lián)系，提出具體技術要求，由乙方按標準規(guī)范設計混凝土配合比。

2. For special technical requirements or special ready-mixed concrete, Party A shall contact Party B at least 7 days in advance to put forward specific technical requirements, and Party B shall design the concrete ratio according to the standard specification.

3.預拌混凝土坍落度是混凝土拌合物的重要技術指標，當坍落度控制目標值≥100mm時，坍落度允許誤差±30mm。有特殊技術要求或特制混凝土，應滿足相關標準規(guī)定和施工要求。

3. Slump of ready-mixed concrete is the important technical index of concrete mix, when the target value of slump control is ≥100mm, the allowable error of slump is ±30mm. special technical requirements or special concrete should meet the relevant standards and construction requirements.

預拌混凝土其他質(zhì)量指標，請參見現(xiàn)行GB/T14902《預拌混凝土》相關規(guī)定。

Other quality indexes of ready-mixed concrete refer to the relevant provisions of GB/T14902 Ready-Mixed Concrete.

二、交貨驗收

2. Delivery and acceptance.

1.同一批次第一車混凝土，必須檢查驗收乙方提供的《預拌混凝土出廠合格證》和第一車混凝土的《預拌混凝土交驗單》（即供貨小票），發(fā)現(xiàn)與用戶要求不一致應立即停止?jié)沧?，并及時與乙方聯(lián)系。

1. For the first truck of the same batch of concrete, the Certificate of Concrete Conformity and the Delivery and Inspection Sheet of Ready-Mixed Concrete (i.e. supply ticket) furnished by Party B with the first truck of concrete should be examined and accepted, and the pouring shall be stopped immediately upon finding any inconsistence with the user's requirements, in addition to contact with Party B in time.

2.混凝土到達澆筑現(xiàn)場，甲方如發(fā)現(xiàn)混凝土拌合物坍落度超出要求，或出現(xiàn)嚴重離析泌水現(xiàn)象，應停止使用并及時與乙方聯(lián)系處理。

2. If the concrete arrives at the pouring site, Party A finding the slump of the concrete mix exceeds the requirement, or serious segregation and water secretion phenomenon should stop using it and contact Party B in time to deal with it.

3.混凝土拌合物由于等待時間長等原因變稠難以泵送，應通知乙方，由乙方技術人員現(xiàn)場采取技術措施處理解決，甲方嚴禁向預拌混凝土中加水。

3. If the concrete mixture becomes thick and difficult to be pumped due to long waiting time, Party B should be notified and technical measures should be taken on site by Party B's technical personnel to solve the problem, and Party A is forbidden to add water to the ready-mixed concrete.

三、澆筑施工

3. Pouring construction

1.澆筑混凝土前應檢查模板支撐的穩(wěn)定性和接縫的密合情況，保證模板在澆筑過程不失穩(wěn)、不跑模和不漏漿。澆筑混凝土前應對積水進行排除，對干燥的地基土、墊層和木模澆水濕潤且不積水。

1. Prior to pouring concrete, check the stability of the template support and the tightness of the joints to ensure that the template will not be unstable, run out of mould and leakage of slurry during the pouring process. Prior to pouring concrete, water should be excluded, and dry foundation soil, bedding layer and wooden mould should be watered and moistened without water accumulation.

2.潤管砂漿只起潤濕管壁的作用，不得澆入結構部位。

2. Pipe-wetting mortar only serves to wet the pipe wall and shall not be poured into the structural part.

3.當混凝土自由傾斜高度大于3.0m時，應采用串筒、溜管或振動溜管等輔助設備。

3. Where the height of free inclination of concrete is more than 3.0m, auxiliary equipment such as skewer, chute or vibrating chute should be used.
